Jaqui is an Associate solicitor in the Dispute Resolution team and is also a member of the Legacies, Trusts & Probate Disputes team.

She advises a variety of charities, social enterprises, trade associations, commercial and private clients on a range of contentious matters. She specialises in advising on and resolving:

  • Contractual disputes
  • Contentious trusts, probate and legacy disputes
  • Tortious claims and general duty of care issues
  • Charity and trustee governance disputes

Jaqui has experience of litigation in the County Court, High Court and Court of Appeal, and has acted on a number of successful mediations.

Jaqui is a contributing author to “The Charities Acts Handbook: A Practical Guide” and regularly speaks at events and seminars, often on the subject of charity legacies.

Dispute Resolution

  • Acted for education charity in a County Court contractual debt claim, helping client to obtain judgment in its favour and an order for the defendant to pay 100% of the charity’s legal costs
  • Acted for a School Academy in a dispute over termination of a service agreement and negotiated a favourable settlement, including obtaining a significant contribution towards the School’s legal costs
  • Acting for a charity bringing an appeal at the Court of Appeal on a breach of contract claim
  • Acting for a claimant in the High Court bringing claims for breach of trust and breach of a Joint Venture Agreement
  • Acting for a national trade association in relation to a trade-member dispute and advising on related appeals procedure
  • Advised an international charity on potential tortious liabilities following fatal injury of a fundraising participant
  • Advised an environmental charity in its investigation of suspected fraud committed by senior charity officers, and on related Serious Incident Reporting and governance matters

Legacies, Trusts, and Probate

  • Acted for a national youth charity in a dispute with solicitors of a deceased gentleman who failed to draft the will in accordance with the deceased’s instructions, depriving the charity of its full legacy; successfully avoided court action and negotiated with other beneficiaries to ensure the charity will receive the full extent of its intended legacy and for the solicitors to cover its legal costs
  • Acting for a care home in its defence of a claim under the Inheritance (Provision for Family and Dependant) Act 1975
  • Acting for a national health charity in relation to a dispute with another charity over the interpretation of the meaning of the gifts in a will
  • Advising executors of an estate on the meaning of a gift in a will where a beneficiary has been mis-described
  • Acting for an international charity legacy beneficiary in relation to a suspected breach of trust by executor of the estate
